Not all famous people have mastered the art of celebrity

Emily Blunt once labelled her Oppenheimer co-star Cillian Murphy as the ‘worst celebrity in the world’.

It’s a well-known fact that being famous requires a lot of standing around and having your picture taken, either in public, on a red carpet or at a press event.

But while most – yes, most – famous people possess exceptional talents, not all of them are naturals when it comes to the art of celebrity.

And it would appear that one of those individuals is actor Cillian Murphy, with fans concerned that he’d skipped this year’s Oscars altogether after he was absent from the red carpet.

“Not Cillian Murphy skipping the red carpet,” one viewer reacted on social media, while a second added: “Cillian Murphy is pulling the Meryl Streep move and skips the red carpet.”

Fortunately, the Irish actor hadn’t forgotten about the Academy Awards altogether and gave us a brief Peaky Blinders reunion when he presented Adrien Brody with the Best Actor gong for his role in The Brutalist.

Perhaps red carpets just aren’t his thing.

One person who would certainly agree with the idea that Murphy doesn’t enjoy the celebrity side of being famous is Emily Blunt, who once branded the 48-year-old the ‘worst celebrity in the world’.

She shared the observation during an interview with 60 Minutes last year, when asked if the 28 Days Later star knew how to ‘handle a compliment’.

“No, I don’t think so. I don’t know if any of the great actors know or would say that about themselves,” the actress responded.

“I feel he’s always in search, he’s looking off the horizon, looking at what else [he] could do, how far [he] could push it.”

She continued: “What will satiate this creative fire in him. I think it would be so painful for him to acknowledge how good he is, I don’t see that happening.”

The interviewer then suggested that Murphy was passionate about his work as an actor but not the celebrity side of things, to which Blunt agreed.

“He’s the worst celebrity in the world,” she replied.

“He’s the best actor in the world and the worst celebrity in the world.”

Going on to explain why she believes Murphy is the ‘best actor’ in the world, the Devil Wears Prada star added: “He’s my favourite actor to work with. He’s unparalleled in what he can do and how he pulls you in. The whole room crackles with a certain life force when you work with him.”

Ukrainian President Volodymyr Zelenskyy and US President Donald Trump got into it last week, and Russia have since responded.

The world leaders met in the Oval Office on Friday 28 February, along with Vice President JD Vance and a number of other American officials, as they looked to hash out a minerals deal.

Zelenskyy ended up leaving the White House early after a heated argument that was caught on camera, not apologising for the exchange and called for the US to ‘be more on our side’.

Trump could be heard telling the Ukrainian leader during the meeting: “You either make a deal or we are out. Don’t tell us what we’re going to feel.”

He went on: “You’re not in a very good position, you’ve allowed yourself to be in a bad position… you don’t have the cards right now… you’re gambling with the lives of millions of people! You’re gambling with World War III!”

While Zelenskyy has since taken to X and spoken out in an interview to clarify his position, Russian officials have taken to social media to share what they think.

Spoiler – they loved it.

Former President and deputy chairman of the Security Council of Russia, Dmitry Medvedev, brutally wrote on X: “The insolent pig finally got a proper slap down in the Oval Office. And @realDonaldTrump is right: The Kiev regime is ‘gambling with WWIII.'”

As reported by Reuters, he also celebrated Zelenskyy’s ‘brutal dressing down’ in a separate Telegram post.

This wasn’t all though, as Russian Foreign Ministry spokeswoman Maria Zakharova added more fuel to the fire in a Telegram post of her own, oddly giving credit to Trump for not being violent against Zelenskyy, showing ‘restraint’.

“I think Zelensky’s biggest lie of all his lies was his assertion in the White House that the Kyiv regime in 2022 was alone, without support,” she wrote.

Zakharova added: “How Trump and Vance held back from hitting that scumbag is a miracle of restraint.”

She didn’t stop there, adding that Zelenskyy was ‘biting the hand that feeds him’, while calling him ‘unpleasant with everyone’.

There are plans for Russian TV commentator Vladimir Solovyov to broadcast a special specifically about the Ukrainian leader’s so-called ‘suicide in the White House’.

Taking to X after the meeting, Zelenskyy simply wrote: “Ukraine needs just and lasting peace, and we are working exactly for that.”

After being accused by President Trump of disrespecting the USA ‘in its cherished Oval Office’, Zelenskyy held an interview with Fox News, hopeful that the relationship with Trump can be saved.

He explained: “Because it’s relations more than two presidents. It’s the historical relations, strong relations between our people, and that’s why I always began… to thank your people from our people,” adding that he is ‘not sure we did something bad’, but admitted that they should hold discussions away from the media.

He went on: “Of course, thankful to the president, and, of course, to Congress, but first of all, to your people. Your people helped save our people… we wanted very much to have all these strong relations, and where it counted, we will have it.

“I just want to be honest, and I just want our partners to understand the situation correctly, and I want to understand everything correctly. That’s about us not to lose our friendship,” he concluded.

On the other hand, Trump wrote on social media: “We had a very meaningful meeting in the White House today. Much was learned that could never be understood without conversation under such fire and pressure.

“It’s amazing what comes out through emotion, and I have determined that President Zelenskyy is not ready for Peace if America is involved, because he feels our involvement gives him a big advantage in negotiations,” he wrote.

“I don’t want advantage, I want PEACE. He disrespected the United States of America in its cherished Oval Office. He can come back when he is ready for Peace,” Trump concluded.

Former pilot and accident investigator Shawn Pruchnicki shared his thoughts on the alarming spate of aviation incidents

A former pilot and crash investigator has shared his thoughts on the terrifying spate of plane crashes which have been unfolding in recent weeks.

Although Shawn Pruchnicki believes air travel ‘is still the safest mode of transport we have’, he’s well aware that a lot of people’s faith in the aviation industry has been shaken.

There have been 119 accidents so far this year, according to data from the US’ National Transportation and Safety Board (NTSB), 16 of which were fatal.

Tragedy has repeatedly struck in the skies over the last two months, causing quite a lot of concern among travellers.

On 29 January, an American Airlines passenger jet collided mid-air with a US army helicopter near Washington, D.C., killing 67 people.

Just 48 hours later, a medical plane carrying six people plummeted to the ground and exploded into a fireball in Philadelphia, leaving all those onboard and one pedestrian dead.

A small chartered aircraft then crashed in Alaska on 6 February, killing ten people.

Disaster then struck again when Delta Flight 4819, which had departed from Minneapolis, flipped as it touched down on the runway in Toronto, on 17 February.

Thankfully, the 76 passengers and four crew members survived – and have each reportedly been offered $30,000 (£23,800) in compensation.

So, you can understand why there are a lot more nervous flyers these days.

According to Pruchnicki, those who work in the aviation industry saw all of these accidents coming – and he believes it’s down to the decline in solid safety measures.

“As a former commercial pilot, crash investigator and expert in accident causation, I have seen the safety buffer that took decades to build steadily eroded in recent years,” he told the Daily Mail.

And this is coming from a guy who boasts experience as a pharmacist, toxicologist, firefighter and paramedic, while he’s also had his research into aviation safety published by NASA and the Federal Aviation Administration (FAA).

“The truth is, the experts have been raising the alarm for years,” Pruchnicki said. “We have watched in horror as planes come within a few hundred feet of each other – on the runway or in the air.

“If planes come within a couple of miles of each other, we start to worry. Any distance noted in feet counts as within a hair’s breadth of disaster!”

The former Delta pilot – who flew for the airline for a decade before being trained in accident investigation at the NTSB Academy – explained he ‘wasn’t surprised’ when the news broke about the American Airlines crash.

Pruchnicki said: “I have long feared that it wasn’t a matter of ‘if’ such a catastrophe would happen but ‘where’ and ‘when.’”

He believes the ‘chronic shortage of air traffic controllers’ plays a key part in the growing number of aviation incidents, while pointing out people in this role are ‘over-worked and over-stressed’.

“They know that if they make a mistake someone could die,” he continued. “Another valid concern is that regional and national airlines are hiring pilots and promoting them through the ranks with less experience than ever before.

“We need to continue to develop and invest in technology that will help pilots and air traffic controllers do their jobs – not to replace them, but to assist them.

“Make no mistake, there is still a pretty good safety buffer in place in our skies but it’s shrinking, and we need to act now if we want to stop it from shrinking further.”

Pruchnicki called for ‘more qualified candidates’ to take up air traffic control positions, while urging aviation bosses to implement any changes the (NTSB) suggests to improve safety.

A recent poll conducted by AP-NORC found that Americans’ confidence in aviation had decreased following the numerous plane crashes this year.

Last year, 71 percent of people in the States said they believed that air travel is very or somewhat safe – and in 2025, only 64 percent of people agree with this statement.

Elon Musk has shared his thoughts on Ukranian President Volodymyr Zelenskyy’s meeting with Donald Trump at the White House after the POTUS accused his fellow leader of ‘gambling with World War 3’.

The meeting between Zelenskyy and Trump on February 28 left viewers across the globe shocked for a multitude of reasons, with some fiercely defending Zelenskyy and his country following their discussion, while others sided with Trump and Vice President JD Vance.

Both leaders fought for the chance to speak during the encounter, with Vance chiming in at one point to tell Zelenskyy he should be ‘thanking’ Trump for ‘trying to bring an end’ to the conflict between Russia and Ukraine.

When Zelenskyy went to respond, Trump said: “You’re gambling with the lives of millions of people. You’re gambling with World War 3, and what you’re doing is very disrespectful to the country, this country that’s backed you far more than a lot of people say they should have.”

The meeting was intended to pre-empt a minerals deal between the two countries, but ended with Zelenskyy leaving before the deal was signed.

In the wake of the contentious interaction, Musk has now expressed belief that Zelenskyy’s appearance at the White House was damaging to his reputation.

Musk spoke out on Twitter after right-wing influencer Benny Johnson shared a post reporting on stats relating to Americans’ ‘trust in Zelensky’ [sic], which he wrote ‘fell from 72% to under 48%’.

Musk shared Johnson’s post, and wrote: “Zelensky [sic] damaged himself severely in the eyes of the public. Just a fact.”

The SpaceX founder then followed up with another post in which he referenced one of his own tweets from October 2022, where he had shared an apparent plan for achieving ‘Ukraine-Russia Pace’.

He wrote: “- Redo elections of annexed regions under UN supervision. Russia leaves if that is will of the people.

“- Crimea formally part of Russia, as it has been since 1783 (until Khrushchev’s mistake).

“- Water supply to Crimea assured.

“- Ukraine remains neutral.”

Musk’s post has received mixed responses from other Twitter users, with some still standing by Zelenskyy and his decisions amid the ongoing war.

After Zelenskyy left the White House, he shared a post in which he stated that Ukraine was ‘truly thankful’ for America’s help to ‘save [its] people’.

A lip reader has weighed in on Demi Moore’s reaction after The Substance star missed out on winning Best Actress at the Oscars.

Moore was favoured to win by many prior to last night’s (2 March) ceremony, with her role as Elisabeth Sparkle in body horror The Substance receiving universal acclaim and seeing the 62-year-old win a Golden Globe for the role.

However, the bookies were proved wrong as the award ultimately went to 25-year-old Mikey Madison.

Moore’s immediate reaction to the loss was caught on camera, leading many to try and decipher what the actress said after Madison’s name was read out.

Lip reader Nicola Hickling has now weighed in on the debate, revealing to MailOnline what she believed Moore said immediately after losing out.

“Demi says ‘nice’ but she isn’t smiling when she says it. Her body is almost nodding like she had to force herself to say it,” she told the outlet.

Fans were also disappointed to see Moore miss out on the chance to take home a Best Actress gong, with many even comparing the decision to The Substance‘s plot. For those who missed the body horror flick, Moore’s character begins taking a black market de-aging substance after being cast out of Hollywood for her age.

“Demi Moore losing Best Actress to a younger, hotter actress is literally what The Substance is about. Crazy,” one user commented on social media.

“Demi Moore was absolutely snubbed and you’ll NEVER change my mind. The Oscars just proved square and fair they don’t take older women seriously and they don’t take Horror seriously,” a second viewer penned, while a third simply added: “Demi Moore robbed.”

While Moore appeared disappointed to have lost out initially, the actress put her feelings aside and could be seen applauding for Madison as she made her way onto the stage to collect the award.

Madison took home the award for her role in Anora, Sean Baker’s romantic comedy film which tells the story Anora Mikheeva, a young stripper who controversially marries the son of a Russian Oligarch.

The actress paid homage to the sex worker community during her acceptance speech, telling the audience: “I also just want to, again, recognise and honour the sex worker community. I will. Yes. I will continue to support and be an ally.

“All of the incredible people, the women that I’ve had the privilege of meeting from that community has been one of the highlights of this incredible experience.”

Anora was one of the biggest success stories of the night, with the film also scooping up five out of the six awards it was nominated for — including Best Picture, Best Director and Best Original Screenplay.

The film featured a mostly Russian cast, with Mark Eydelshteyn, Yura Borisov, Darya Ekamasova and Aleksei Serebryakov also starring.

This has since been chalked up to the sinister machinations of Harvey Weinstein, who Den of Geek reports started a ‘whisper campaign’ claiming the only good part of Saving Private Ryan was the first 20 minutes, with the rest being ‘sentimental hokum’.

DreamWorks marketer Terry Press recalls Spielberg telling him ‘I do not want to get down in the mud with Harvey’ when he was urged to fight back amid Weinstein’s bullish campaign tactics.

Director Ang Lee claimed in a 2024 Deadline interview that support for his tragic gay love story ‘had a ceiling’ amid the Academy of the time.

He even recalls being told to stay in the wings of the stage in-between his Best Director win and the announcement of Best Picture, being told by a stage manager: “Everybody assumes you will win.”

It’s clear this one still hurts for many cinephiles, with one calling Crash’s win ‘absolutely criminal’.

Jeff Goldblum was caught red handed at the 2025 Oscars, which took place in the Dolby Theatre in Las Vegas last night (2 March).

The Jurassic Park star was in the audience as he played the Wizard in Wicked, which received 10 Oscar nominations, taking home two in Best Costume Design and Best Production Design.

But before the show, Goldblum, was caught doing something hilarious by a cheeky camera behind him, as he and wife, Emilie Livingston, waited for the show to begin at 7pm ET.

While many film stars may have been chatting with others or carrying out interviews prior to the event starting, Goldblum was doing something different.

The 72-year-old was seen scrolling on his phone – not too bad, right?

Well, that’s until the camera zoomed into the device, which revealed that the actor was looking at photos of himself from his appearance on the red carpet, just moments before.

To be more specific, Goldblum was seen looking at an Instagram post showcasing his outfit.

Him and Livingston were seen staring at the phone, as they were sat in their seats ahead of the ceremony.

Both took the red carpet by storm prior, though the couple were surprised when they were interviewed by Entertainment Tonight after being caught.

As they were called for an interview, one of the reporters pointed out: “They caught you tonight,” to which the star replied: “Oh gosh look at that, let me see.”

After seeing the images of himself looking at, well, images of himself, the Kaos actor admitted: “I’m busted, that’s it.”

The reporters said that they were doing the same thing, which makes it okay, though the eccentric actor joked: “Where are more pictures of me? That’s my question,” before adding that it was ‘a good one’ with the photos.

Goldblum previously confessed that he still feels ‘lucky’ to be able to go to the Oscars, 29 years after his first and only win, for his live action short film, Little Surprises in 1996.

Explaining why he felt that way, he wholesomely admitted: “It always feels like the first time for me, and to see it through Emilie’s golden eyes makes everything more.”

The film that brought him to the awards this year, Wicked, will be returning for a sequel in November 2025, titled Wicked: For Good, where Goldblum will reprise his role as the Wizard in the Wizard of Oz prequel.

Late night host O’Brien had jaws on the floor with several of his gags – after he’d graphically emerged from a nude Demi Moore’s body in a skit referencing The Substance.

In his opening monologue, he hit out at Emilia Perez star Karla Sofía Gascón, whose controversial tweets were widely believed to have torpedoed her awards chances.

He quipped: “Anora uses the ‘F-word’ 479 times – that’s three more than the record set by Karla Sofía Gascón’s publicist.”

In a later dig on Trump’s disastrous meeting with Ukraine President Volodymyr Zelenskyy, he said: “Anora’s doing great tonight. Two awards. I think Americans are finally ready for someone to stand up to a powerful Russian.”

For context, Anora sees a stripper face off with a Russian oligarch and his wife after a shotgun wedding with his son.

Most controversially, O’Brien said around the halfway point: “Well, we’re halfway through the show, which means it’s time for Kendrick Lamar to come out and call Drake a pedophile.”

This, of course, a reference to Kendrick Lamar’s Super Bowl halftime show, where he performed Drake diss track ‘Not Like Us’.

It doesn’t matter how famous you are – rules are rules

For actors, winning an Oscar Award is an achievement like no other, but there is something that winners have to agree to that is non-negotiable.

The likes of Keiran Culkin and Mikey Madison bagged gongs as last night’s Oscars, with Anora director Sean Baker becoming the first person ever to win four Oscars in one night: for Best Editing, Best Original Screenplay, Best Director and Best Picture.

Of course, at the ceremony, nominees are called out (usually), the winner is then announced, and then they come up on to the stage where they are given an award and make a speech thanking the Academy and their families.

While it’s a routine that seems to have been perfected across the time the ceremony has been running, there is one rule surrounding the trophy, and also what winners can do with it once they take it off-stage.

If you didn’t know, there is a ‘regulations’ section on the Academy Awards website that explains that Oscar winners are banned from attempting to sell their trophies unless they meet a certain requirement.

I know what you’re thinking – the Oscars statues are among the most coveted in the world, why would anyone try to sell one?

Well, it’s unlikely, but it is possible that particularly successful stars might start running out of space to put their awards and decide to swap one for cash, or perhaps attempt to sell off the statue for a good cause.

Whatever the reason for selling an Oscar may be, The Academy explains: “Award winners shall not sell or otherwise dispose of the Oscar statuette, nor permit it to be sold or disposed of by operation of law, without first offering to sell it to the Academy for the sum of $1.00.”

That’s right – the statue might be plated in gold, but winners are tied to offering it to the Academy for just $1 if they choose to sell it.

The website adds: “This provision shall apply also to the heirs and assigns of Academy Award winners who may acquire a statuette by gift or bequest.”

The rule has been in place since 1951, and it’s even sparked lawsuits against some who failed to comply.

In 2014, Joseph Tutalo auctioned off an Oscar that his uncle, Joseph Wright, had won in 1943. It successfully sold for $79,200, but The Academy then sued Tutalo and the auction house for breach of contract.

A California judge later ruled in favor of the Academy, forcing the person who’d won the auction to return the statue.

However, it seems there are times when the rules have been bent, with money exchanging hands in 1999 when Michael Jackson forked out $1.5m for the Best Picture Oscar awarded to producer David Selznick in 1939. Selznick died in 1965.

Adrien Brody has been slammed by Oscars viewers after being caught on camera exhibiting rather gross behaviour.

Brody, 51, secured the award for Best Actor at last night’s Academy Awards ceremony for his role as László Tóth in The Brutalist, beating the likes of Timothee ChalametColman Domingo, Sebastian Stan and Ralph Fiennes.

However, the actor’s achievement was overshadowed after fans noticed a ‘disgusting’ exchange between himself and girlfriend, Georgina Chapman.

The camera panned over to Brody as he walked onto the stage to accept the award and caught the actor pulling a piece of used chewing gum out of his mouth and tossing it behind him.

Now, I’d imagine that chomping on a piece of gum while delivering you acceptance speech is generally frowned upon, but the done thing would be to discreetly deposit the chewy into a piece of tissue or a wrapper? Apparently not.

To make things even weirder, Chapman then ran towards the flying gum and caught it in her hands, making sure that Brody wasn’t caught on camera littering at the biggest night in the Hollywood calendar.

Naturally, the internet had a lot to say about chewing gumgate and not a lot of it was positive.

“Not Adrien Brody doing the, ‘hold my gum,'” wrote one shocked viewer on X, as a second added: “Adrien Brody could’ve used his long speech to apologise to his partner for throwing gum at her.”

Others were even more blunt with their thoughts in the interaction and outright slammed Brody for chucking the gum.

“No shade but Adrien throwing that gum at his wife was so tacky and gross,” penned a third viewer.

“Disgusting. he could have swallowed,” added a fourth.

However, not all of the internet was filled with a baying mob furious over Brody’s actions, as some viewers seemed to think the exchange was rather sweet.

“I would’ve been fighting for Adrian Brody’s piece of gum like a wedding bouquet,” wrote a second.

The chewing gum toss wasn’t the only viral moment of Brody’s, as Halle Berry got her own back after their infamous moment from the 2003 awards, which saw Brody controversially kiss the X-Men actress without her consent.

The actor also received backlash for the length of his acceptance speech, which overly long acceptance speech. “Adrien Brody’s speech is gonna have an intermission,” joked one viewer, while others compared it to The Brutalist‘s three hours and 35 minutes runtime.

The American model and actress was the subject of an unwelcome kiss from Brody, 51, when she presented him the Best Actor award at the Oscars in 2003.

He has since addressed the backlash against his move as let’s be honest, an unsolicited kiss just isn’t okay.

But at this year’s awards, Berry took charge and laid her lips on this year’s Best Actor winner.

Brody was awarded Best Actor for the second time in his career, for his performance in the film The Brutalist, as László Tóth, an architect who comes to America to rebuild his life.

Prior to all of this though, the actor was on the red carpet with his partner of five years, Georgina Chapman, and in the middle of an interview when Berry eyed him up.

The incident between the pair has caught wind recently, as people have criticised Brody’s actions, but it looks like the floor is level.

In the video, she can be seen approaching Brody, apologising to Chapman, then taking him for a playful lock of their lips.

He seemed unbothered, smiling and giving her a peck on the cheek afterwards, before Berry went over to Chapman and gave her a kiss on the cheek.

As for the first kiss at the Oscars 22 years ago, Brody had just become the youngest ever winner of Best Actor, at just 29 for his role in The Pianist.

When he went up on stage to collect his award from Berry, he laid a kiss on her, despite her not expecting it, before starting his speech saying: “I bet they didn’t tell you that was in the gift bag.”

But in a recent interview with Variety, he has since admitted: “We live in a very conscious time, which is a wonderful thing,

“And nothing that I ever do or have done or would’ve done is ever done with the intention of making anyone feel bad.”

However, Berry has also commented on the original kiss, saying Andy Cohen’s Watch What Happens Live back in 2017: “I was like, ‘What the f**k is happening right now?’ That is what was going through my mind.”

Berry admitted she gave Brody something of a pass, as she understood the surreal feeling he was experiencing after winning Best Actor.

“I was there the year before and I know the feeling of being out of your body,” she added. “I just f**king went with it.”

It looks like there are no hard feelings at all between the pair, with Brody taking the latest kiss light-heartedly, while Berry poked fun at the controversy around it all.

A family was left shocked after builders handed them back ‘half a house’ when construction was finished up.

Having moved from Nepal to Sydney, Australia, Bishnu Aryal planned on starting a family and building a new life, paying AU $700,000 (about £392,792) to build a home in Edmonson Park.

But after three years of work, the man returned to his custom off-plan home to discover his free-standing building had instead essentially been turned into a duplex.

Featuring on Aussie news show A Current Affair back in 2021, the house literally looked like it had been halved thanks to it being flat and windowless on one side.

“It’s not a free-standing house, it’s not a duplex, it’s half a house. And it looks embarrassing,” he said.

English is not Aryal’s first language, but he said he didn’t sign up to half a duplex.

“They were promising us the house will be ready in one year time, but we wait for three long years. When we come to see the progress of the building, we see our building was different to what we were expecting,” the dad claimed.

He said he ‘nearly fainted’ when he rang the supervisor to ask what was going on as he was apparently told ‘it’s a duplex, semi duplex’.

Having purchased a plot of land, Aryal had paid Zac Homes AU$322,400 for the build but claims he was ‘not given any notice’ of the changes to the design plans.

However, the company say Liverpool Council required the man’s lot to be an attached dwelling.

A legal letter to A Current Affair from Zac Homes stats Aryal was made aware and had multiple opportunities to pull out. But he said he trusted the process.

“When bank asked, I called them and said can you please send the plan and I forward the plan to the bank. I didn’t look,” he explained.

But those plans were for half a duplex – not quite the whole house he was envisioning.

Making things worse, his family had to move into the place during the covid pandemic as his wife was pregnant and he was ‘losing work’.

Yet they didn’t have an occupation certificate which Zac Homes said it had been trying to get signed off for nine months. The council however wanted a guarantee that the other half of the duplex would be built on the land.

Zac Homes said on Facebook it had waived a fee ‘to alleviate some of [the family’s] stress’.

“It’s a mess. We know that. Even though this situation hasn’t been caused by us, we are doing what we can to ensure that the right thing is done by Mr Aryal and his family,” it added.

Zac Homes said in a statement in 2021: “Zac Homes’ position is that:

“A. Mr & Mrs Aryal were aware of the change to the dwelling design from detached to attached, as evidenced by:

“i. Mr & Mrs Aryal’s attempt (through their conveyancer) to negotiate a discount to the price via the Glory Group (see paragraph 12 above);

“ii. Glory Group’s advice to Zac Home on 6 June 2018 that Mr & Mrs Aryal wished to onsell Lot 719 because of the change of dwelling design (see paragraph 13 above);

“iii. the Restriction registered with the Subdivision Plan (and the presumption that Mr & Mrs Aryal’s solicitor advised them of the Restriction) (see paragraph 14 above); and

“iv. Zac Homes providing a copy of the amended plans and specifications on 2 April 2019 whilst Mr & Mrs Aryal continued to have a right to rescind the Land Contract (see paragraph 16 above).

“B. As Mr & Mrs Aryal were aware of the change the dwelling design, they could have elected to rescind the Land Contract (see paragraph 6 above), which would have automatically terminated the Building Agreement (see paragraphs 7 and 20 above).

“C. Mr & Mrs Aryal chose not to rescind the Land Contract, instead purchasing Lot 719 with a discount of $20,000.00 off the price in the Land Contract. 6

“D. The Certifier either invalidly issued the Construction Certificate, or has invalidly refused to issue the Occupation Certificate.

Accordingly, whilst Zac Homes appreciates the frustrations of Mr & Mrs Aryal surrounding the delay in the issue of the Occupation Certificate, these delays are not caused by Zac Homes. Instead, Zac Homes has worked diligently and at its own cost to attempt to remedy the outstanding matters so that the Occupation Certificate can issue. Zac Homes has also agreed to:

“(a) defer payment of its final progress claim from Mr & Mrs Aryal pending issue of the Occupation Certificate; and

“(b) waive a contract price increase of $22,733.20 permitted under the Building Agreement.”
